THE ROLE OF A BARRISTER

Barristers are specialised legal professionals. They appear on behalf of individuals and organisations before courts and tribunals, either through written submissions or personal appearances. Barristers must be highly intelligent and have a command of the English language, both written and spoken. They must possess the ability to think and communicate clearly under duress, as well as stamina and emotional fortitude. They must, among other things, sift through and analyse massive amounts of information, apply the law to the facts, and present persuasive legal arguments in court.

 

THE NEW BAR COURSE

By 2020, the Bar Courses will have largely displaced the Bar Professional Training Course (BPTC) as the vocational component of bar training. While course providers may use a variety of different terms to describe their programmes, it is crucial to note that all courses lead to the same end result - completion of the vocational component of bar training. Furthermore, bartending classes are referred to as:

• Bar/Barrister Training Course (BTC)

• Bar Practice Course (BPC)

• Bar Vocational Course (BVC)

• Bar Vocational Studies (BVS).

 

The BSB has authorised a number of institutions, known to as Authorised Education and Training Organizations (AETOs), to conduct Bar examinations. According to the Bar Standards Board (BSB), the revised qualifying criteria make legal training more flexible, accessible, and affordable than ever before. Additionally, the revisions broaden the pool of potential talent for the Bar by allowing students to choose between different routes to qualification.

WHAT IS DRAFTING?

​

Drafting is a critical and essential skill for a barrister. It is the barristers who write up all statements of case, be it particulars of claim, a defence, response or counterclaim. Drafting encompasses all of these, for all different areas of law. It requires one to succinctly and professionally set out the facts of a given case, structure the effects your client would have experienced, the detailed particulars of any contract (and all terms therein), breach/breaches, duties, negligence, and loss of all types, to provide a thorough and professional picture of the case from your clients perspective combined with a robust logical argument(s) on the facts. This must also be drafted in the specific format accepted by the court, and accordingly, as set out in the CPR itself and up to the standards of a practicing member of the Bar.

A DRAFTING LAW TUTOR

As one of the 12 assessments on the Bar course, most students are typically given only a few months (and around 6 – 8 lessons) to master this up to a professional standard before their formal assessment. This is on top of the other 11 modules. This, combined with the fact that the assessment itself only gives you 3 hours to produce your draft in full (including reading the case papers), means many Bar students will struggle to meet their potential in terms of learning, preparing, and ensuring they get the best mark they can achieve.
